Odpowiedzialność za wielokrotne spowodowanie zagrożenia bezpieczeństwa w ruchu drogowym
Streszczenie
Dokonując analizy normatywnej art. 86 § 1 k.w. i art. 174 § 1 i 2 k.k. oraz poglądów prezentowanych w orzecznictwie i literaturze, autor wyraża tezę, że dopuszczalne jest kwalifikowanie wielokrotnego naruszenia zasad bezpieczeństwa w ruchu drogowym i spowodowania zagrożenia tego bezpieczeństwa zarówno jako wykroczenia z art. 86 § 1 k.w., jak i przestępstwa z art. 174 § 1 lub 2 k.k. Podnosi, że do zakwalifikowania takiego czynu jako przestępstwa niezbędne jest wykazanie, że zagrożone było życie lub zdrowie wielu osób, albo mienie w wielkich rozmiarach. Uważa, że jeżeli skutki działania sprawcy nie osiągnęły tego progu, odpowiedzialność z art. 86 § 1 k.w. jest możliwa tylko w sytuacji, w której sprawca zagroził bezpieczeństwu ruchu drogowego.

Responsibility for causing multiple safety hazards on the road
Abstract
The author carries out a normative analysis of Art. 86 § 1 Code of Petty Offences, Art. 174 § 1 and 2 Penal Code, and views presented in the jurisprudence (past rulings) and literature. He argues that it is acceptable to categorize multiple violations of traffic safety and causing a threat to road safety both as a petty offence under Art. 86 § 1 Code of Petty Offences and a crime under Art. 174 § 1 or 2 Penal Code. He further argues that to categorize such an act as a crime, it is necessary to show that the life or health of many people was threatened or that property was threatened to a great extent. He considers that if the effects of the action of the perpetrator have not reached this threshold, responsibility under Art. 86 § 1 Code of Petty Offences is possible only in a situation in which the perpetrator has threatened road safety.

Wypadek na promie rzecznym. Czy prom to droga?
Streszczenie
Artykuł dotyczy wypadku polegającego na tym, że w czasie przeprawy promowej przewożony promem samochód ciężarowy stoczył się z promu do wody wraz z kierowcą, który dostawszy się do kabiny, usiłował zaciągnąć hamulec ręczny. Samochód jednak wpadł do wody wraz z kierowcą, który utonął. Prywatnym (subsydiarnym) aktem oskarżenia został o ten wypadek oskarżony operator promu. W toku prowadzonego postępowania operator ten został prawomocnie uniewinniony. Autor omawia motywy takiego rozstrzygnięcia i zwraca uwagę, że pomimo iż prom nie jest drogą publiczną, to jednak przepisy ustawy Prawo o ruchu drogowym mają tu swoje zastosowanie.

Accident on a river ferry. Is a ferry a road?
Abstract
The article concerns an accident consisting in the fact that during a ferry crossing, a truck transported by a ferry rolled off the ferry into the water together with the driver, who, having got into the cabin, tried to apply the hand brake. However, the truck fell into the water together with the driver, who drowned. The ferry operator was prosecuted for this accident with a private (subsidiary) indictment. In the course of the proceedings, the operator was acquitted. The author discusses the motives for such a decision and draws attention to the fact that in spite of the fact that a ferry is not a public road, the provisions of the Road Traffic Act are applicable here.

Autor omawia wymagania, jakie przewozom towarów niebezpiecznych stawia ustawa z dnia 19 sierpnia 2011 r. o przewozie towarów niebezpiecznych, w korelacji z wymaganiami międzynarodowej umowy o przewozie towarów niebezpiecznych ADR. Podaje również, w formie tabelarycznej, zestawienie naruszeń, powinności i kar, jakie obowiązują w transporcie towarów niebezpiecznych.

Guarantees of safety of transport of dangerous goods
Abstract
The author discusses requirements under the Act of 19 August 2011 on the Transport of Dangerous Goods, stipulated for shipments of dangerous goods, in conjunction with requirements under the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR). He also presents, in table form, a list of violations, duties and penalties that apply in the transport of dangerous goods.

Bezpieczny odstęp między pojazdami
Streszczenie
Przedmiotem artykułu są problemy, jakie wiążą się z utrzymaniem bezpiecznego odstępu między pojazdami uczestniczącymi w ruchu. Autor omawia tzw. odstęp przedni, tj. odstęp między pojazdami poruszającymi się tym samym pasem ruchu, w tym samym kierunku, oraz tzw. odstęp boczny, występujący między bokami pojazdów przejeżdżających obok siebie lub między bokiem pojazdu a innym uczestnikiem ruchu albo przeszkodą.

A safe distance between vehicles
Abstract
The subject of the article is problems which are linked with keeping a safe distance between vehicles participating in road traffic. The author discusses the so-called front gap, i.e. the distance between vehicles driving in the same lane in the same direction, as well as the so-called side gap, occurring between the sides of vehicles passing next to each other or between the side of a vehicle and another traffic participant or obstacle.

Co to jest niezależność biegłego i komu jest potrzebna
Streszczenie
Artykuł traktuje o relacjach między biegłym a organem procesowym, wynikających z uwarunkowań formalnych i mentalnych. Artykuł zwraca uwagę na niektóre z tych problemów utrudniających współpracę organu procesowego z biegłym, które są możliwe do wyrugowania na poziomie współdziałania konkretnego organu z konkretnym biegłym. W szczególności, artykuł wskazuje, że warunkiem koniecznym znaczącej poprawy wykorzystywania pracy biegłych z zakresu wypadków drogowych przez organa procesowe jest merytoryczne współdziałanie decydenta procesowego z powoływanym biegłym, niezależnie od konieczności zmiany prawa określającego status biegłego.

What is experts independence and who needs it
Abstract
The article deals with relations between experts and procedural bodies stemming from formal and mental conditions. The article draws attention to some of the problems that hamper cooperation between the procedural body and the expert, which can be eliminated at the level of cooperation between a specific organ and a specific expert. In particular, the article indicates that a necessary condition for a significant improvement in using the work of experts in the field of road accidents by procedural organs is substantive cooperation between the judicial decision-maker and the summoned expert, irrespective of the necessity of a change in the law defining the status of the expert.
