HUMAN RIGHTS, PARENTS’ RIGHTS, CHILDREN’S RIGHTS. CONFLICTS OF INTEREST IN CUSTODIAL CASES – A CASE STUDY

Streszczenie
This case study illustrates conflicts of interest which are played out on two levels: the ostensible and the real. Outwardly, there are the violations by state institutions of the rights of individuals, parents and children. Meanwhile, though, the real conflict concerns bringing up and educating children in such a way that they benefit from the positive feelings of their parents without being exposed to their “toxic” influences. Can one extend and enhance the capacities of parents with personality disorders to bring up and educate their children? Can the serious mistakes the parents make be corrected? Can the vicious cycle of deepening family pathology be ended and can the deep developmental disorders of the child be neutralised? In this paper a forensic expert reflects on these issues.
